Charlotte King, M.D provided the informed consent and was expected to perform the surgery. However, Dr. King was notified at approximately 8:10 am that her daughter was in a car accident on her way to school. Before leaving for the emergency department to see her daughter, Dr. King paged her partner, Dr. Frank Joseph, M.D. to perform the surgery on Ms. Kennedy in her place. During the course of the surgery, Dr. Joseph left a sponge in the patient. A second surgery was performed by Dr. King four days later to remove the sponge. The second surgery was successful and Ms. Kennedy went home the following day. Determine if Ms. Kennedy has any cause of action. Please discuss your reasoning
