The plan was to open it for business from May 1st to September 30'h every year. Esha signed a contract with a construction company to build the waterpark. As part of their discussion of the project before they signed the contract, Esha explained that because the waterpark will only be open for 5 months every year, timing is essential. She also discussed her marketing plan which included a big advertising push weeks before the opening, followed by fortnightly concerts by famous artists to attract crowds to the waterpark. She anticipated that because of the increased advertising and promotion expenditure in the rst year, she will only make a prot of one million pounds. According to the contract, the construction company was supposed to nish the construction by April 15'. Based on this, Esha paid one million pounds to an advertising company to promote her new waterpark- She also made contracts with bands and artists to perform in her waterpark in the summer, and paid a total of 3 million pounds in non-refundable down payments to the artists. On March 15', the consthction company informed Esha that they will not be able to nish the work on time. The earliest expected date for completion would be September 15'. Esha immediately contacted the advertising company and the artists asking if they could refund the money she had paid, or whether they would reschedule the advertising campaign and concerts for the following summer. They all refused. Advise Esha on her rights and remedies in relation to the construction company
