Evaluate the elements of a crime, apply those elements to a set of facts to establish what, if any, crime has occurred.
Facts Scenario:Adam suspects that his wife, Susan, is cheating on him and hires Dennis, a private detective, to follow her. Dennis finds that Susan, a high school teacher, is having an affair with Jackson, one of her students. Dennis shares this information with Adam. Adam gets very angry and says that he could kill her for cheating. Dennis tells Adam that he knows someone that could discretely take Susan out of the picture. Adam says he is interested and takes Mark's telephone number. Adam calls Mark to arrange his wife's murder. Mark tells Adam that he will kill Susan for $25,000. Adam gives Mark the money and tells him the details of Susan's daily routine. Mark guarantees that Susan will be dead by the end of the day. Adam later changes his mind and leaves Mark a voice message cancelling the orders. It is too late. As Susan is leaving the gym, Mark approaches her with a gun and demands her purse (to make it look like a robbery). Susan hands over her purse, and Mark shoots her in the head. Susan dies in the parking lot. During Susan's autopsy, it is discovered that she has HIV, and a review of her medical records indicates she knew that she was infected. Assume that Susan knowingly transmitted the disease to Adam.
