Examine the United States Constitution and the constitutions of Oregon and one other state of your choosing (other than South Dakota, which is an outlier). Don't analyze them separately: answer Question 1 for all three, then Question 2, and so forth.

  1. How are they organized? Don't tell me they are organized into articles and sections - tell me about the organization of the subject matter of the articles and/or sections; ignore the preambles, articles describing state boundaries, and articles adopting the US Constitution. Do you think the order of the articles might tell you something about how the drafters of the constitutions felt about the priority of the subjects addressed by the articles? Explain. Don't simply provide a list of the constitutional provisions!
  2. Are amendments added separately at the end of the constitutions? How many amendments are there to each of your constitutions? Do they tend to expand or restrict the power of the government? Discuss.
  3. What is the order of the constitutions in terms of length? Provide a word count or page count but be sure that whichever form you use you're comparing the same thing: don't compare pages if the pages have different formats (spacing, font size, etc.). Did your findings surprise you? Why or why not? A solid paragraph, plus your numbers, will suffice.

4. What overall observations can you make about constitutions, based on your review of these three? Are constitutions general in nature? Specific? Can you think of any advantages or disadvantages of being general or specific? A couple of paragraphs should be enough to answer this question.

5. Find in the Oregon Revised Statutes (ORS) the specific statutes that deal with motorists who are stopped by the police for suspicion of driving under the influence of intoxicants. Can a motorist refuse to take field sobriety tests? If so, what are the consequences of such a refusal? Identify the statute by its number and title.

6. Locate the Oregon Supreme Court case of In re Wollheim, which was submitted in January of 2008. What is that case about?

Again, a couple of paragraphs here is plenty. Don't just summarize the case - tell me what it is about. Again, be careful - this is not a gimmie!
