Exercise 2:[10 marks]Writing a Memorandum of Advice

Assume that you are a new graduate at a firm of lawyers in Australia.

Your supervising partner asks you to draft a memorandum of advice. This advice is ultimately for a wealthy but uneducated client. Your draft will go to the senior partner of your firm for review before going to the client.

The advice topic is:

'The advantages and disadvantages of resolving disputes through mediation, arbitration, and litigation'.

Students must:

• draft a concise research plan; include this in the introductory commentary

• research and identify the relevant law and policy issues
• draft thememorandum in clear, concise, and correct plain language

Ps: I just wanted a general idea on how I could draft a memorandum of advice I have done it a few times but never got it right.
