In July, 2016, Rodney Thermal (age 17, known as Hot RodHR), toured Western Pacific University in Hammingbell (a private college). He was much impressed with the College of Liberal Arts brochure that it would teach justice, character, enlightenment, honesty, wisdom and that upon graduation he would be a well-rounded and thoughtful person He applied, enrolled and was accepted into the University, signing an agreement to repay the University for educational expenses after he graduated (he got a college loan).

During his senior year in 2020 (he was now 21), HR determined to learn some social graces. He took a free dance lesson from Dance Studios, Inc. The instructor Darla Dancer, praised him greatly, telling him he had real potential, that he could be great dancer, that he was awesome. Pleased with such compliments, Hot Rod contracted for 10 weeks of lessons at a cost of $1000; he paid $500 down and owed $500. The contract provided, This contract is non-cancelable and no refunds will be made.

In mid-May, pushing a shopping cart in the produce section of Supermarket (a partnership owned by Paula and Peter Partner), HR slipped and fell, spraining his ankle. He looked where he had fallen and saw a squashed cherry; the pit was on his shoe. HR was hospitalized and fitted with a clunky leg cast. He needed crutches to get around, and certainly dancing was out of the question for many months. Moreover, upon reflection in the doctors office, HR realized this truth: even before his accident, he would never, by any stretch of the imagination, be a great dancer. No way. It wasnt his talent.

HR telephoned his parents about his accident, and they--a little worried about their son--contacted a friend of his, Natalie, who also attended WPU. Natalie had a crush on Hot Rod (she was sort of in love with him, dont you know), and tended to him while he was laid up and couldnt drive (about two weeks), tidied up his apartment, ran errands, cooked some meals, and so on until his cast was removed in early June.

But HR, still using a crutch, fell down while getting out of his car on campus. A campus police officer helped him to his feet. In so doing, she felt a baggie-like thing in his shirt pocket; she frisked him, found a baggie of pot, confiscated it, and gave HR a ticked for $30the penalty for having pot on campus. In mid-June, 2020, HR graduated, leaving town and leaving Natalie.

3. (a) What argument, if any, can HR use to get the pot citation dismissed? Will he win? (Pay attention to the facts with care.)

(b) HR had used $400 worth of dance time when he was injured. He wanted a refund of the remaining $100 down payment and said he was excused from paying the outstanding $500. Dance Studio insisted he forfeit the $100 left on the down payment and that he owed the other $500. Who wins; why?

4. Natalie, ticked off at HR now, insisted she should be paid something for the hours of service she rendered to Hot Rod. Is Natalie entitled to compensation for the services she rendered to him? Explain
