Personal Jurisdiction is the power of the court over the parties in the case. Before a court can exercise power over a party, the constitution requires that the party have minimum contacts with the forum in which the court sits. In this case Margolin's lawsuit against Funny Face and Novelty Now will have jurisdiction over them since they contacts through the use of the internet. Mr. Margolin Could use these grounds to file suite and get compensation. As for subject matter jurisdiction, this is the power the court may have to hear cases of a particular type or cases relating to a specific subject matter. Under federal and state jurisdictions, Mr. Margolin should be able to file suit since the company Funny Face committed a form of health care fraud by having a non FDA approved chemical in their aftershave. I believe he should win some sort of compensation on this if he were to go this route. Long arm principles will not work wither since Funny Face and Novelty Now do not have any minimum contacts within New York.
