Facts: Human Animal Removal Solutions (HURS) has won a large tender to make and supply human animal traps for several local Tasmanian councils. The contract to supply the animal traps will commence in six months' time and there will be work for about 18 months for Javan and Forest to undertake the trap manufacture, which is estimated to last two and a half years.
A month before the first work orders are due, Javan is informed by the state government, as part of the new North- South Tunnel Link project, that it will compulsorily acquire the building owned by HURS at 3 Simbar Place, Huonville and HURS and the other two commercial tenants will have to vacate the premises within six months. It will take Gary time to find another warehouse factory and it could take another three to six months to set up the factory to commence production of the animal traps.
Required: Please use PIRAC method to analysis the case and advise HURS in relation to the contract to supply the local councils. Please refer to legal principles and case law as applicable. (PIRAC stands for Parties, Issues, Rules, Application and conclusion).
