Faizul, the original owner of a red BMW entrusted his car to a mechanic named Saiful for repairs to be carried out on the car. Saiful also owned a shop that sells second hand-cars at a nearby town. Shortly after obtaining Faizul's car and repairing it, Saiful put the car on display at his shop. Saiful received an offer for the car from Mimi and sold the car to Mimi for RM85, 000.

Upon discovering this, Faizul decided to take action against Mimi on the ground that she was not entitled to the car.
