Feedback for summary

Although there are a few safeguards to prevent frivolous lawsuits from being taken to trial, the most important one is a summary judgment. A summary judgment is where a judge determines if there is a true need for trial, which diminishes the chance of wasting time and court resources on pointless lawsuits (Lane, 2003). A motion for summary judgment can be filed by the defendant if the facts and laws side together to rule against the opposing party. If a summary judgment is granted, the case is dismissed.

After reading this week's articles and watching the video, I do not believe in tort reform. I believe that the safeguards we have in place currently are effective enough in preventing and dismissing frivolous lawsuits. If a judge reviews a motion for summary judgment and deems the case worthy of a trial, then it shouldn't be considered a frivolous lawsuit. Also, if a case can make it through one safeguard, there are still two others in place.
