Felix and Oscar, citizens of Indiana, are plaintiffs in an action brought in the United states District Court in Ohio against OddCo, a Kentucky corporation, and madicorp, a Ohio corporation. Oddco's office and plant are located in Kentucky. At no times has Oddco had an office or salesman in Ohio. madicorp;s sole place of business is in Ohio. the complaint alleges that each of the plaintiffs sustained serious personal injuries when a blade broke on an electric lawn mower while the equipment was being demonstrated by a clerk in Madicorp's store in Ohio. Each plaintiff requested damages in the sum of $80,000. The mower had been manufactured by OddCo and shipped to Unger in Indiana. Unger had a contract with OddCo to act as exclusive distributor of OddCo products in eleven states, including States Ohio and Indiana. Process was served personally on the president of OddCo at OddCo's office in Kentucky and on the president of Madicorp at its office in Ohio. thereafter the following occurred:
1. OddCo moved to dismiss the action on the ground that the court had no jurisdiction over it.
2. Madicorp filed a counterclaim against Felix for $74,00 alleged to be due for merchandise perviously sold to Felix.
3. OddCo filed a cross-claimed against Madicorp for $12,000 alleged to be due for merchabdie perviously sold by OddCo to Madicorp.
The U.S. District Court can assert personal juridiction over Oddco:
A. If the assertion of personal jurisdiction would comport with due process (there being nationwide service of process in actions commenced in federal court).
B. If the amount in controversy exceeds $75,000 exclusive of interest and costs.
D. If Ohio has an appropriate long-arm statute and the assertion of personal jurisdiction would comport with due process.
