Danny was at a party at his friend's apartment. The apartment complex was home to multiple students, and there were several gatherings there that night. Late in the night, after Danny had consumed several beers, he and a few other people thought it would be funny to see if they could throw a beer bottle far enough to hit a balcony across the courtyard. Danny threw an empty bottle toward the balcony but came up short. Instead, the bottle smashed onto the pavement, and broken glass flew up and cut a passerby, Vicki, as she walked home. Vicki had several small cuts on her legs and was bleeding, but she did not need medical attention.

If you were a prosecutor, would you charge Danny with assault? If so, which one? If not, why not? Discuss whether each of the four statutes applies by indicating if any of the elements are or are not satisfied. Also, discuss any ambiguities in the language of the statute.
