Question:
First, watch the crash course on 'Due Process' listed for this week and then read the short article on a Virginia fight club published by the Washington Post (link below and Word Doc at the bottom):
https://www.washingtonpost.com/local/for-8-years-he-held-a-grudge-could-a-6-minute-fight-with-his-enemy-end-it/2019/09/27/9598d020-e15f-11e9-8dc8-498eabc129a0_story.html(Links to an external site.).
Guidelines for all students:
One of the main goals of the judicial branch is to mediate and solve disputes between two opposite parties. With that in mind, after reading the newspaper article and based on all the class material discussed so far:
1a) Explain in detail what is this article about and b) how it connects to our class (be explicit and explain why that is the case).
1b) Next, describe in detail if a fight club (as the one described in the article) could become a mainstream approach in America to solve disputes between two individuals without going to jail and to avoid a lengthy and expensive trial if both sides consent to the fight. Be explicit in your response and includearguments, ideas, and theoretical concepts from class material. To earn credit for this question class material must be included in your answer.
2a (If you agree with the fight club idea), assume that the local government would have to create some rules to regulate fights, provide at least three rules (think like a judge or lawyer) that you consider will be necessary to have a fair, non-deadly, and equal fight to solve a personal dispute. Remember, one of the missions of the judicial system is to provide a venue to settle disputes between private parties, how the fight club option could replicate this principle of the courts.
2b. (If you disagree with the fight club idea), write instead an alternative method or process to settle personal disputes for women or men that could be equivalent to a fight club. Think outside the box and (use all the class material discussed so far to) explain in detail what that option could be (be creative about it!). For instance, playing a chess match and whoever wins is the winner of the dispute (this example is taken, you cannot use it for your post).
(Students either choose 2a or 2b according to your personal interpretation, but do not answer both, just one item).
3. Finally, a) explain what would be the equivalent of due process in the club fight under analysis and why that is the case (due process as explained in the crash course on this topic listed for this week). If you think that due process is not possible in this particular case or inappropriate, explain it in detail and argue why that is the case. B) At last, write down what did you learn from this newspaper article or the due process video that you did not know before.
