In order to guarantee free access to recreation for children and adolescents with disabilities in areas intended for children's playgrounds, the Policy and Research Directorate (DPI) of CONADIS established the scope of application, scope and agents required to comply with the General Law on Persons with Disabilities.
According to article 17.2 of the referred norm, "public and private spaces of public use for recreational purposes that have playground equipment must be accessible for children and adolescents with disabilities and comply with universal design standards".
In this regard, through the Binding Technical Report 000001-2023-DPI, the institution specifies and clarifies that the obligation to adapt recreational spaces also applies to restaurants and food service providers.
This is due to compliance with the technical standards of the National Building Regulations, with special emphasis on Technical Standard A.120, on universal accessibility to facilitate equal conditions and contribute to the process of independent living of people with disabilities.
Likewise, the institution specifies that any private space for public use or that offers public services must comply with the criteria of universal design, accessibility and good treatment, in order to guarantee the participation of persons with disabilities, thus promoting their social inclusion and contributing to achieve an inclusive society without barriers.
As is public knowledge, restaurants belong to the commercial sector, being their main activity the preparation and commercialization of food and beverages to the public, and not the provision of services for recreation. However, since they also have recreational games for children, their income must be accessible to underage users.
