Following the Watergate scandal, Congress adopted a statute authorizing the appointment of special prosecutors to investigate misconductby the executive branch. Under this statute, Attorney General Reno recommended the appointment of a special prosecutor to investigate the allegations regarding President Clinton's relationship with Monica Lewinsky. The investigation was supervised by a three-judge panel. Under the statute, the special prosecutor's finding must be reported to Congress. How should this process be classified? Since Congress has permitted the Special Prosecutor law to lapse, we will never know the final answer to this constitutional conundrum.
