QUESTION 3 - CAPACITY (MINORS) Bradley, the 17-year-old son of wealthy parents who live overseas, is enrolled at a regional university. Before leaving his capital city home he pays a small deposit for a $350 000 Porsche sports car which he is allowed to take away because the dealer knows his parents. At university, Bradley learns about extreme poverty in developing countries. He wishes to repudiate (reject) the contract for the Porsche and donate the value of the car to the charity, World Vision. (8 Marks)QUESTION 4 - GENIUNE CONSENT AND LEGALITY Ashley owns a car sales showroom and specialises in selling what she calls "Brand New Used Cars". A customer named Bryan enters the showroom and seeks advice on a suitable car to use for his proposed new taxi business which he will operate from the city area. While showing Bryan around her range of cars, Ashley recommends one particular model, a Supremo, which Ashley claims that it is brand new, smart looking and economical to run. Ashley also tells Bryan that the car has very low mileage and has been properly serviced and all the parts were basically new. Bryan was so impressed and three weeks later he decides to buy the car since he thought that it is new and one time investment for his business. Bryan pays $35 000 cash and collects the vehicle the following day. A month later, Bryan is disappointed to find that there are some rust patches on the interior of the car door and that, far from being economical, the car is very expensive to run and consumes a lot of fuel. In addition, the exhaust is now worn and only a small part of the system had been replaced recently. Apart from spending more than he intended on fuel, Bryan has lost the trade in value for the car amounting to several thousands of dollars and also he lost hundreds of dollars on his taxi business because the car is being off road and getting repaired.
