Austin responded to its online ad, advising Forest Products he had extensive experience in the industry and was currently operating his own lumber business. However, what he failed to mention was that his lumber business had been closed years before and that since then he had been working in a number of jobs outside of the lumber industry, including working as a truck driver and as a security guard. Forest Products hired Austin but was soon very disappointed in his sales performance. After discovering the truth about when Austin's lumber business had closed, it fired him for just cause, arguing that it had hired him based on his having current contacts within the lumber industry. Austin sued for wrongful dismissal.
