Fred Creek recently was hired by Timko Barton, Inc. in the accounting department. Timko Barton is the world's leader in musical washboard sales. Fred works for the CFO who travels each month to Washiteria Arkansas, the washboard manufacturing capital of the world. In his first month at Timko, Fred is asked to sign a contract for Timko because the CFO is traveling. Fred signs his name to the contract "Fred Creek" and does not indicate his position at the company. Several months later, litigation over the contract ensues and the other party to the contract sues Timko corporately and Fred individually. Is Fred individually liable for the contract because he signed as an individual? Can an accounting grunt like Fred even sign a contract for Timko?
