From LaGuardia to the Marquis Anne Rutgers works as a cabdriver for the Star-shine Cab Company. While on a routine run transporting a passenger from New Yorks La Guardia Airport to the Marriott Marquis Hotel in Times Square, she collided with a car driven by Ian Harrington. Harrington wanted to sue both Rutgers and the Star-shine Cab Company. He did so under the doctrine of vicarious liability because Rutgers was (a) an employee under the control of the cab company and (b) operating within the scope of her employment.
