FRQ 1- Scenario Application Civil Liberties Marsy's Law for All is an organization engaging in a national campaign advocating in states for victims' rights. The organization advocates for giving victims and their families the right to refuse to be interviewed by the lawyers of the accused. This particular objective has raised concerns over fairness in criminal trials and whether Marsy's Law violates the United States Constitution. The Wisconsin Association of Criminal Defense Lawyers released the following statement: "Marsy's Law would allow 'victims.' who accuse someone of a crime . . . to refuse to provide evidence that may be essential to the determination of the accused's innocence. This mandate undermines fundamental Constitutional protections that our Founding Fathers guaranteed to protect our citizens who are presumed to be innocent from being wrongfully convicted by allowing them to discover and present evidence in support of their innocence. . . ." States can include victims' rights in their state constitutions, but many civil liberties organizations have questioned whether these victims' rights provisions are in conflict with the Constitution. The fourteenth amendment guarantees equal protection under the law, which means that nobody who is accused is set at an advantage or disadvantage during the trial procedure. Opponents of Marsy's law say that it violates the fourteenth amendment in that it does not ensure equal protection because it puts the accused at a disadvantage as evidence is withheld from them that may aid in their acquittal, which violates disclosure. 3. The scenario demonstrates federalism in that it exemplifies the "give and take" and cooperation between the states and federal government. This form of cooperative federalism is what creates balance in our democracy. C. People often try to amend state constitutions because it is easier to amend than the national constitution. When a state constitution and a national constitution conflict. the national constitution takes precedence, commonly called the supremacy clause
