Gerry purchases a new television from a retailer, 'The Big Guys'. Gerry explains that he has poor television reception in his suburb and he wants a television and aerial that will allow him to receive and view all available television stations. The salesperson shows Gerry several televisions as well as a number of aerials. Gerry is eventually convinced to purchase an expensive set with an equally expensive reception amplifier. Gerry takes the television home and installs it, according to the instructions on the box. The television works well for most television stations, but several stations are very fuzzy and not really watchable. A neighbour is called in to look at Gerry's television. The neighbour tells Gerry that everyone in the area actually uses a very different type of aerial amplification and that the aerial Gerry has is at the lower end of useability. The neighbour also points to the scratches at the back of the TV - it looks as if the TV has been previously used and is not brand new. What are Gerry's rights under the Australian Consumer Law (ACL) regarding the purchase of the TV?
