At a downtown bar, Walter drinks to excess. He is driving home with a friend Paula, at the first intersection, he strikes and injuries a pedestrian who was crossing with the light. Walters Blood alcohol level proves to be twice the legal limit. Has he committed any torts and crime?

Answer: Yes he has committed a tort and crime as he should not be drinking and driving. Additionally, the pedestrian had the light to cross the road.

Walter and Paula both have identical smart phones. Once Walter is no longer intoxicated, he tells Paula that she has taken his phone accidentally, as he believes it is his phone. Paula insists that it is her phone, when she is not looking, Walter takes Paula phone, believing it is his. Has he committed any torts or crimes?
