The relevant terms of the Lease agreement are : a) The lease agreement commences on 1 July 2020 and continues for a period of 24 months. b) The rental amount is R50 000 per month. which Is payable on or before the 7th day of each calendar month, into an account nominated by the lessor. c) The lessor nominates the account in the name Supreme Properties {Pty) Ltd, held with New Bank, lllovo branch. as the account into which payment must be made by Janine. d) The rental amount is payable monthly in advance. e) Failure to pay the rental amount on or before the 7"! day of each calendar month may result in the LWPY221 Final Formative Assessment Paper 82 2020 | V1.0 Page B of 7 lessor cancelling the lease agreement. Janine banks at New Bank and signs a stop order at her Sandton branch to pay an amount of R50 000 into the tessor's nominated bank account on the 7th day of each calendar month. On 1 August. Janine sub-lets the premises to Megan. Megan signs a stop order at the lllovo branch of New Bank (Megan's bank) to pay R50 000 into the lessor's nominated bank account on the 71" day of each calendar month, commencing on 7' November. Payments for August and September go through without a problem. But by 9th October, New Bank has failed to transfer the R50 000 into the lessor's nominated bank account. As a result, the lessor cancels the lease agreement. Megan maintains that it was not her fault and as such the landlord breached the lease agreement by cancelling it.
