Janine banks at New Bank and signs a stop order at her Sandton branch to pay an amount of R50 000 into the tessor's nominated bank account on the 7th day of each calendar month. On 1 August. Janine sub-lets the premises to Megan. Megan signs a stop order at the lllovo branch of New Bank (Megan's bank) to pay R50 000 into the lessor's nominated bank account on the 71" day of each calendar month, commencing on 7' November. Payments for August and September go through without a problem. But by 9th October, New Bank has failed to transfer the R50 000 into the lessor's nominated bank account. As a result, the lessor cancels the lease agreement. Megan maintains that it was not her fault and as such the landlord breached the lease agreement by cancelling it.
