Greenfields Soccer Club (GSC) owns extensive grounds and fields used for soccer games throughout the popular and lucrative eight month soccer season. Its club facilities include a restaurant and bar leased and operated by Sport Bar Ltd which is frequented during the soccer season by players and spectators. GSC entered into a contract with Play Grass Ltd to resurface its playing fields with a new form of artificial grass that was to be well-drained, weather proof and highly resistant to mould and fungus. The work required new foundations and drainage and Play Grass Ltd undertook to complete the work in the off- season so that it would be ready for use in the 2017 soccer season. After Play Grass Ltd had entered the contract with the GSC, it sub-contracted the drainage work to Wet Foundations Ltd. The work was completed on time but heavy rain early in the playing season quickly showed that there were substantial drainage problems caused by defective foundations installed by Wet Foundations Ltd, which should have been checked and corrected by Play Grass Ltd. GSC noticed the problem but continued to use the fields for matches. Players from their own and other teams complained of nasty fungal infections from grazes incurred while playing on the sodden fields. When some required hospitalization, GSC ceased using the fields and was forced to lease land from the local council elsewhere in the municipality for the rest of the season. Sport Bar Ltd has seen its profits plummet after the games shifted away from GSC grounds. Further, both GSC and another club, Real Soccer Club (RSC), argue that they have suffered financial loss because, while their star players were recovering in hospital, they saw a loss of revenue from ticket sales which was only stemmed when they paid high fees to bring in substitute players from Korea to complete the season. Advise Play Grass Ltd, with reference to appropriate authority, on the following questions: a) Play Grass Led admits liability for breach of contract but denies that it is solely liable for GSC's leasing costs.
