Statement of Grievance:

I, Chimene Shenge, am filing a grievance against my employer, Yummy Juice Company, for violating the collective agreement, specifically Article VII: Overtime Compensation. On November $13$th$,2023,$ I was required to work overtime to meet an urgent project deadline. According to the collective agreement, any overtime work should be compensated at a rate of $1\mathrm{.}5$ times the regular hourly rate. However, the employer failed to provide the agreed$-$upon overtime compensation for the extra hours worked.

Adjustment Requested: That my record be made whole in all respects,

I request that my record be made whole in all respects, and the employer compensate me for the overtime hours worked in accordance with Article VII of the collective agreement.

As the supervisor, I, Ann McDonald, have thoroughly reviewed Chimene Shenge's complaint regarding the alleged violation of Article VII: Overtime Compensation. After careful consideration, I acknowledge the validity of the employee's claim. Chimene Shenge is entitled to compensation for the overtime hours worked as per the collective agreement. Therefore, I fully support the adjustment requested by Chimene Shenge and highly recommend that the employer compensate them for the overtime hours worked at a rate of $1\mathrm{.}5$ times the regular hourly rate in accordance with Article VII of the collective agreement.

Department Manager's Reply:

After carefully reviewing Chimene Shenge's grievance regarding the alleged violation of Article VII: Overtime Compensation, I, Dorothy, have determined that the employee's claim is valid. The supervisor's reply did not satisfactorily adjust the grievance, and as per the collective agreement, I hereby render a decision that the employee should be compensated for the overtime hours worked. The compensation should be provided at a rate of $1\mathrm{.}5$ times the regular hourly rate, and the adjustment should be reflected in the upcoming payroll cycle.

Director's Reply:

I, Thomas, have thoroughly reviewed the grievance presented by Chimene Shenge regarding the alleged violation of Article VII, which pertains to overtime compensation. After carefully considering the department manager's reply, I agree that the resolution provided did not satisfactorily address the grievance.

In accordance with the collective agreement and in recognition of the employee's rightful claim, I affirm the decision that the employee should receive proper compensation for the overtime hours worked. The compensation, as outlined in Article VII, should be processed at a rate of $1\mathrm{.}5$ times the regular hourly rate.
