This project contains the case of an employee who has been terminated by his company. His union has grieved the termination but the grieve has not been settled between the union and management.Therefore, the union has referred the grievance to arbitration. This type of arbitration is called "grievance arbitration" or "rights arbitration".

In this project, you will develop and present arguments for both the Company (supporting the termination) and for the union (arguing that the termination was not appropriate in the circumstances).

Each one of your arguments must be supported by a point of law. You will draw your points of law from the LAC's that I will provide. LAC's are "Labour Arbitration Cases". They contain the decisions and points of law from previous labour arbitrations. Decisions by previous arbitrators on previous grievances make up the common law or jurisprudence for rights arbitrations.

Your deliverable for this project will be four arguments that management might make in support of their decision to discipline and terminate the employee and four arguments that the union might make. Remember, two issues are being argued: was their just cause for some form of discipline and whether termination was the appropriate form of discipline.

Each argument must address a specific fact in the case, must cite a point of law and must make a clear and cogent argument that supports your position.

Your arguments must be written in the language that you would use as if you were addressing the Arbitrator during the arbitration hearing.
