H and W were married to each other and after repeatedly failing

to conceive a child, consulted a fertility clinic. They agreed by

contract to participate in an assisted reproduction program

through artificial insemination.

The program was a success and the resulting fertilized embryos of

W were stored pending implantation into W's uterus. Prior to

implantation, H and W agreed to divorce. W now claims she is

entitled to the embryos and seeks to have them implanted in her.
