Harvey Vector (HV) is a young graduate accountant employed by Price Watergate Scooters Pty Ltd (PWS). PWS is a corporation that provides financial services throughout Australia, such as general accounting services, auditing, bookkeeping and financial advice.

Upon commencement of his employment with PWS on 1 February 2017, Peter was working under the supervision of Louis Bitt (LB) who conducted due diligence reports on companies known in the travel industry. LB was well known throughout PWS for his notorious temper and anger.

From the time of his employment, LB got PWS involved in a team for the preparation of an extensive due diligence report for the potential takeover of a well known public company within the travel industry. The first purchase of shares in the takeover target was due to occur on 15 April 2017 and the final due diligence report was due on 10 April 2017.

From 1 February 2017 until 21 March 2017 ("the relevant period"), LB sent 2 emails to PWS every day in the following terms:

You make sure that you have a draft of the due diligence report sent to me by 5:00pm on 5 April 2017. If you don't, you can forget about having any career as an accountant or in the financial services sector. I will bury you if you do not meet this deadline!!!!

Additionally, 3 times a week during the Relevant Period, LB would enter HV's office and say to him, in very loud words:

Listen, wimp, if you don't have a draft of the due diligence report sent to me by 5:00pm on 5 April 2017 I will have your arse on a platter!!!! You will be a cooked goose as far as the accountancy profession is concerned!!!

On 4 occasions during the relevant period, when he was saying the above words, LB threw a book against the wall of HS's office, which landed about 2 metres from where HV was sitting.

HV was extremely upset about the above conduct. Initially, he began having nightmares and then could not sleep at all. On 15 March 2017, he was diagnosed with major depression and was prescribed a range of anti-depressant drugs. He started seeing a psychiatrist about 3 times per week.

As it was his first job, HV said nothing to any of the senior management or directors about LB's conduct. However, HV was aware that PWS had procedures available within PWS to resolve grievances or disputes within the workplace.

HV wants LB's behaviour to stop. On 22 March 2017 he comes to you for legal advice. Can HV do anything to stop LB's behaviour? If so, what? In your answer, please refer to relevant sections of any legislation and any relevant common law. In your answer, please follow the ILAC format.
