Tosh has a cement company in which he provides services to businesses and homeowners to build and repair sidewalks and driveways. Britney owns a shopping mall and is in need of a complete re-pavement of the surfaces surrounding the mall.Tosh and Britney negotiate a contract in which Tosh will complete the services by April1 and Britney will pay him $150,000 for his services.On March 15, Tosh is contacted by Vince who offers to pay him $500,000 for repaving needs that he has. Vince explains that he needs the project completed by April I. Tosh agrees and, realizing that he will need to rent more machinery to complete both jobs by April1, tells Britney that he can't finish by April 1 because his costs have risen and he needs an additional $5,000 to rent materials to assure completion by April1. Britney agrees. Tosh completes Britney's job on March 31 and sends Britney an invoice for $155,000. Britney only agrees to pay the original $150,000 contract price. Tosh sues Britney. Who wins and why?
