Can you help me with two questions I do not understand.

Tosh has a cement company in which he provides services to businesses and homeowners to build and repair sidewalks and driveways. Britney owns a shopping mall and is in need of a complete re-pavement of the surfaces surrounding the mall.Tosh and Britney negotiate a contract in which Tosh will complete the services by April1 and Britney will pay him $150,000 for his services.On March 15, Tosh is contacted by Vince who offers to pay him $500,000 for repaving needs that he has. Vince explains that he needs the project completed by April I. Tosh agrees and, realizing that he will need to rent more machinery to complete both jobs by April1, tells Britney that he can't finish by April 1 because his costs have risen and he needs an additional $5,000 to rent materials to assure completion by April1. Britney agrees. Tosh completes Britney's job on March 31 and sends Britney an invoice for $155,000. Britney only agrees to pay the original $150,000 contract price. Tosh sues Britney. Who wins and why?

Veronica and Archie visit UrbanZoo on a cool, crisp Miami day. On the back of the tickets they are required to purchase to enter the Zoo are a number of boilerplate clauses, including one that prominently states: "Ticket Purchaser waives any and all claims for any injury(ies) suffered while on the premises of UrbanZoo on the date of the use of this ticket regardless of the cause(s) of the injury(ies)."While enjoying their stroll through the Rhinoceros Repository, a rhino escapes from its holding area and charges Veronica and Archie, leaving them severely injured. Upon investigation, it is discovered that UrbanZoo allowed an employee with only one week of experience to single-handedly supervise the Rhino Repository and that this employee failed to properly secure the gate. Veronica and Archie sue UrbanZoo for their injuries.What defense will UrbanZoo argue, what is the likely outcome, and why?
