Hello, Case study:
Bassam, a university student, inherited from his grandfather an apartment in the residential area of Hamra. To purse his specialization abroad, he decided to sell the apartment. As he is not an expert in the field, he sought the help of a broker Wael. As a remuneration, Wael asked for 5% from the transaction as it is a practice in trade. Bassam agreed. it did not take much time to Wael to find a buyer for the apartment. And when Bassam and Rayan (the buyer ) signed the sale contact at the Notary Public, Wael claimed his commission. Bassam refused to pay him stating that the buyer should pay the whole amount. Wael would like to go to the court to present a case against Bassam.
- what do you label the above practice in trade? Do you think that Wael can use the Consitution as a legal base for his claim? Present two arguments to support your answer.
- Wael would like to present the case at the Appeal Court. is it possible? why?
