I have a client Ricky who went on vacation to Florida.

While he was there, Ricky decided to buy a used car in Florida and drive back to Montana. He bought a 1974 Fordham Pintobean because it was painted neon green; that would make it easier for him to find his car in the Montana snow after he got home.

All good things must come to an end, and the same was true for Ricky's vacation. When that time came, Ricky filled up the gas tank on his new old car. Then he started driving north.

As soon as Lucy's car struck Ricky's Pintobean, a fireball consumed both cars. Even though Ricky had already applied his brakes due to the slowed traffic, the force of the hit from Lucy's car caused Ricky's car to strike Ethel's pickup truck, which was in front. Lucy died as a result of the accident, while Ricky sustained serious burns and multiple broken bones. Ethel suffered whiplash and a nervous breakdown because of the accident.

Several months later, a process server knocked on Ricky's door at his Montana home, and handed him an envelope that contained all of the necessary paperwork from Ethel, who was suing him based on that dreadful accident. Ricky has now come to your attorney's small law firm (Mee, Mihself and Eye); he wants advice on what to do now.

Mr. Mee has to help in preparing the case. In particular, he wants there draft memorandum about a single issue: whether Florida (the state where Ricky bought his car) has a lemon law that could possibly be used in Ricky's case. If so, then he wants you to analyze that law relative to the above- described fact pattern.
