I have a question regarding an two Australian court cases: Kong v Minister for Health [2014] FCAFC 149; and Yu v Minister for Health [2013] FCA 261.

Both submitted their relocation applications under the National Health (Australian Community Pharmacy Authority) Rules Determination 2006 Rules. I thought the rules meant only 1 pharmacy in a rural location, but in Moree there were already 2 pharmacies present. How come the pharmacies in Moree were not in breach of the NH Act?
