1. Samantha, a California resident, travels to Oregon to visit the University of Oregon campus. Samantha is thinking about attending the university and wanted to visit the campus before deciding. While in Eugene, Oregon, Samantha buys a skin care mask from a street vendor on 13th Avenue, a "street fair" type area where local vendors sell their products. The vendor, Mike Malarky, who is the sole proprietor of Paradise Skin Care (PSC), has his headquarters and a small retail store in Eugene and does not market his products outside of Oregon. Samantha was very excited about trying his organic face mask, but decides to wait until she gets home later that day. Samantha finally arrives home in Sacramento, California after a long 8 plus hour drive. She is extremely tired and decides it would be quite relaxing to apply her new face mask. Samantha suffers an extreme reaction to the products contained in the mask and suffers "burn like" scarring on her face and neck. Understandably upset, Samantha sues Mr. Malarky and PSC in state court in Sacramento, California court for her injuries asserting a claim for negligence and product liability.

Assuming that the cause of action is valid, does the California court have personal jurisdiction (In Personam) over the dealer, Mike Malarky and his company Paradise Skin Care?

2. Mike, the owner of Paradis Skin Care (PSC), after receiving notice that he is being sued by Samantha, decides to go to Vegas for a few days to blow off steam. While in Vegas he meets another couple from California, Jack and Judy Osbourne from San Francisco. Mike tells them all about his skin care line and Judy Osbourne is extremely interested in many of his products. Mike agrees to call them when he returns to Eugene, Oregon to provide more information about his product line and pricing details. He also faxes over a 4-page color brochure outlining the specifics of his company and product line. The couple flies to Portland, Oregon for other business, but Judy decides to drive down to Eugene to visit Mike's retail store in downtown Eugene. Judy purchases an assortment of skin care products from Mike and PSC. A week later, Judy is at home in San Francisco and she decides to try a facial scrub she purchased from Mike and PSC. The scrub causes severe redness and abrasions to her face and leaves scarring on her nose, cheeks and chin. Judy sues Mike for negligence and product liability and files the lawsuit in state court in San Francisco, California. Mike has no other contacts with California.

Again, assume the cause of action (lawsuit basis) is valid, does the state court in California have personal jurisdiction (In Personam) over Mike and PSC?
