Anoushka attends the MoshPit club in Leeds one Friday night. Whilst in the club, Deepak (one of the security staff) sees Anoushka handing what looks like small packets to other people in the club. The police are called. Anoushka is found to be in possession of twenty tablets suspected to be ecstasy, a large quantity of cash and pieces of paper with names and phone numbers scribbled on them. An unknown woman comes up to PC Cristal in the club and saysto her "everyone knows she's a dealer, she's always at it here!" but in the confusion of the club PC Cristal does not make a note of the person's name and they are never seen again. Anoushka isarrested on suspicion of Possession of a Controlled Drug of Class A (Ecstasy) with Intent to Supply and Supplying a Controlled Drug of Class A (Ecstasy), contrary to the Misuse of Drugs Act 1971.

Subsequently, the police search Anoushka's home address. They recover a mobilephone registered to Anoushka containing 15 text messages asking "can you sort me out for Friday?". Deepak gives a witness statement to the police describing Anoushka's suspicious behaviour at the club, but ten days before the trial is due tostart, he leaves the UK for a two-year round-the-world cruise and will not be available to give evidence in person in court. Anoushka denies the charges, saying that the drugs were for her own use and the text messages and pieces of paper with names and numbers are to do with vitamin supplements she sells in her shop.
