Scenario:

A restaurant of German cuisine in New York City seeks to fill a server position. The advertisement requests applications from qualified individuals who are Germanor of German ancestry to add to the authenticity of the restaurant. There are three equally qualified applicants, two of German ancestry, one a natural-born American citizen,the other born in Germany who is not a US citizen.The third applicant is an American-born citizen of non-German ancestry.

Question:

The US citizen of German ancestry is hired. Do either or both of the other applicants have a basis for a discrimination charge?Why? Please Fully explain.
