Mario tried to swerve to avoid collision, but it was already too late. The boy was badly hurt.

a.) The boy's parents decide to file a case against Mario. What is the proper basis of their complaint? Explain.

b.) Mario argues that the complaint against him has no basis because he was not at fault: he was at the right side of the road and the boy was not at the pedestrian lane and was almost at the middle of the road. Is he correct? Basis.
