Mario was having a leisurely motorcycle drive along Hibbard Avenue one afternoon after undergoing quarantine. There was not much traffic due to the pandemic. Deriving great pleasure from the drive, Mario upped his speed to more than 40kph. Suddenly, a boy emerged from the side of the road. Mario tried to swerve to avoid collision, but it was already too late. The boy was badly hurt.

a.) The boy's parents decide to file a case against Mario. What is the proper basis of their complaint? Explain.

b.) Mario argues that the complaint against him has no basis because he was not at fault: he was at the right side of the road and the boy was not at the pedestrian lane and was almost at the middle of the road. Is he correct? Basis.
