One case ( scenario or situation) per Article . Example- Abnoy Travel and Tours owner of 5 computer sets and Tonying a repairman agreed to make repairs on the said computers orally. Despite repeated demands, no work was done thereon. Eventually, Tonying returned the computers unrepaired and worse, several parts were missing, thus the description cannibalized and unrepaired. Abnoy Travel and Tours was then constrained to have the computers repaired in another shop. Abnoy Travel and Tours now claim damages from Tonying for the costs of the repairs and the cost of the missing parts..

a) Can Tonying be held liable for damages? Answer; Yes, Tonying can be held liable for damages and this would include the cost of labor and needed materials as well as the value of the missing parts. According to Art 1167 - if a person obliged to do something fails to do it, the same shall be executed at his cost. The same rule shall be observed if he does it in contravention of the tenor of the obligation. Article 1170 Those who in the performance of their obligation is guilty of fraud, negligence, or delay and those who in any manner contravene the tenor thereof, are liable for damages.
