In 2008 Samantha Elauf interviewed for a position at Abercrombie & Fitch. Ms Elauf attended the interview wearing a headscarf (hijab), she did not mention her religion or request an exception to Abercrombie dress code (Collins & Sokolowski, 2015, P.1). She received a rating to qualify for the position, but was not considered due to the companies look policy. The company imposes a look policy that governs its employee dress (Supreme Court). The company believed her scarf was for faith, but felt it violated their dress code. Elauf filed a complaint with the Equal Employment Opportunity Commission (EEOC). They filed a lawsuit against Abercrombie & Fitch. The case made its way up to the Supreme Court. They ruled 8-1 against Abercrombie. Title VII intentional discrimination prohibits certain motives (Collins & Sokolowski, 2015, P.3). Title VII includes no more than an unsubstantiated suspicion that accommodation would be needed (Collins & Sokolowski, 2015, P. 3). In the United States we enjoy given our relatively free market system. Having a free market, businesses should be governed by the laws of supply and demand, not restrained by government interference (Fieser, 2015, Section 2.1). Companies have the freedom to do what they want with their businesses.
I believe Abercrombie & Fitch is responsible for the problem that led to the lawsuit. Abercrombie & Fitch didnt know for sure why she was wearing the headscarf, but had a strong suspicion (Wall Street). They chose to ignore it. Abercrombie & Fitch business activity had a certain dress code called the Look Policy. They prohibited Caps, but did not define it (Supreme Court). Theyre interpretation of caps, discriminated against Ms. Elauf because she wore a headscarf. Hiring regulations such as Title VII the disparate-treatment provision forbids employers to fail to hire an applicant because of such individuals religion (Supreme Court). The ethical theory of this interplay would be Kants Deontology. Kants Deontology is defined by treating persons with respect and without denying them dignity or autonomy (Zuniga y Postigo, 2015). Abercrombie & Fitch denied employment to Ms. Elauf because of her religious beliefs to wear a headscarf. They did not know for sure why she wore it, but had a strong belief. They could have easily made the necessary accommodations for applicant.
