In the spring of 2019, Tom Tripe lived in Sagrado, Texas. He was famous for online gambling and made several hundred thousand dollars. On July 4, 2019, Tripewon $165,000 playing blackjack on Winbig.com, a Nevada-based online casino that frequently advertised on Facebook's home page. While illegal in Texas, online gambling was legal in Nevada where Winbig.com was located. Nevertheless, on July 5, 2019 Winbig.com notified Tripe that they would not pay Tripe the previous day's winnings. Furious at the news, Tripe sought to sue Winbig.com. In his quest, Tripe discovered that Winbig.com was an unincorporated business owned by Harry Horsely, a shady character who kept his permanent residence in Las Vegas. Fortunately for Tripe, Horsely spent most of the year in Texasat his Sagrado residence. To make matters worse, Tripe-in his quest to save big money-opted to sue in his pro se capacity. Tripe sued Horselyin the Federal District Court for the Southern District of Texas and hired Ricardo Mota, a professional process server, toserve the summons on Horsely. Two days later, lazy and inept, Ricardo Mota served the summons by taping it to the gate of Horsely's palatial estate. Horsely found the summons but decided to ignore it. Tripe then got a default judgment for $165,000 from the Federal District Court. When Tripe tried to enforce the judgment with a lien on Horsely's palatial estate, Horsely challenged the judgment in federal court.
