According to the facts in the case, Donald Trump before he was the President of the United States had an affair with a porn star just after Mr. Trump and his wife had a child named Barron. Sadly enough, here is where the problem begins. In or about 2011, Stormy Daniels was promised $15,000 for selling the rights to her story about her and Mr. Trump. According to the story, she signed a contract with In Touch magazine to tell her entire story and not to reveal anything about the affair. She was not allowed to disclose the details of story to any other news outlet or individual until the story was released. It just so happened that In Touch never released the story. Stormy was still under the obligation of the contract not to disclose the events to anyone else. It just so happens that Mr. Trump desired to run for President of the United States in 2016 and the lawyer for Donald Trump named Michael Cohen gave Stormy Daniels a "non-disclosure agreement" to make sure that she did not reveal the details of this story to the press. The contract was signed by Micheal Cohen and Stormy Daniels, with a space for a name of an individual named David Dennison. The space for David Dennison was not signed. The theory is that David Dennison was indeed Donald Trump but this is still being ascertained. Here are my questions about this topic, 1. Was the contract signed by Stormy Daniels a unilateral or a bilateral contract? How can you tell? 2. Was there consideration given for the original contract between Ms. Daniels and the news outlet? How can you tell? 3. Was there consideration for the second contract between Michael Cohen and Stormy Daniels? Was there an offer and acceptance of that contract? 4. Assuming that the allegations are true by Stormy Daniels that there was a threat by someone from the Trump Organization keep her quiet after she was paid $130,000 to keep quiet. Would this considered to be duress? Could the contract be invalidated by the duress that Stormy Daniels is alleging if the allegations are true
