Pat and Chris are neighbours in Palmerston North. Pat wishes to build a garage on her property but if she does she will have to drive on Chris's property to reach the proposed garage. Pat approaches Chris and offers to pay Chris $2,000 for the 2m2 she needs to gain access. Chris is delighted and agrees immediately, as the piece of land is of no real benefit to his property. Before Pat can take any further steps, Chris is offered promotion by his employer and the new position is in Christchurch and so Chris puts his property on the market. When he tells Pat, Pat immediately offers a cheque for the $2,000 so that the matter of access to his new garage can be dealt with before Chris's property is sold. Chris says, "I am sorry, I just want to sell the property as it is, so I am not prepared to let you have the 2m2 after all." Advise Pat whether the agreement with Chris to sell the land would be enforceable

Polly Flinders is 17 years old. Polly is still at school studying for University Bursary Examinations. Having been given $700 from $3000 her mother won on the "Instant Kiwi", Polly naturally looks around for something on which to spend her newfound wealth. Polly sees an advertisement from Mother Goose Travel Ltd, which promises "Seven Nights in Sydney for $650". Polly is attracted by this and makes inquiries. Bill Winkie, who is the Wellington manager for Mother Goose Travel, tells Polly that there are seats available in the August holidays but that to secure one; Polly needs to pay the full amount immediately. Polly is thrilled at the thought of visiting Australia; she hands over the cash, and receives her ticket and her accommodation voucher. Polly has now had second thoughts, prompted in part by a wish to purchase a $500 leather jacket. When Polly tells Bill that she wishes to cancel the trip, Bill says that she can but the terms of the contract are that the $650 is non-refundable. Advise Polly whether there are any grounds on which her money is recoverable.
