Hey Parminder, I didn't see anything about Henry's salary being reduced. Only his hours. In fact, his hours would probably see a net increase since he now had to work weekends. I think the main thing for Henry is that his responsibilities have been dramatically changed effectively forcing him to work 7 days a week. I believe any judge or arbitrator would consider this unreasonable and as such either the company should accommodate Henry or the non-competition clause in his contract should be void (Yates et. al 2019). When you mention that the company can demand a change in salary, do you think they would be in a position to lower his salary? Or do you think that would also qualify as Constructive Dismissal?
