Show Markup Toolbar Sheila was a 21 year-old woman employed by Mark, the owner and manager of a marina at the beach. Sheila's job was to manage the office staff and to attend tourism industry functions with Mark for the purpose of positioning the Marina as a tourism destination for boaters, sailors, divers, and fishing boats. One day, a salesman came to the office when Mark was not there and convinced Sheila that she needed to upgrade the office equipment. Sheila leased two large copier/printer/scanners for a three- year term, at a cost of $10,000 per year. Mark noticed the new copiers but didn't pay much attention until the invoice arrived after they had been using the new copiers for about a month. Mark was livid, screaming at Sheila that she was never authorized to incur such a large expense. After two months, Sheila claimed her employment was terminated because she would not engage in a personal relationship with Mark. She based her complaint on a series of incidents alleged to be sexual harassment. These included: sexual comments to and about her: "blonde" jokes (Sheila has blonde hair), suggesting that she share a hotel room with Mark while travelling on business in order to minimize costs. Mark admitted he was attracted to Sheila, but said it was she who made advances to him and that she proposed a relationship. He alleges that she was terminated for other reasons, including: Sheila kissing him on the neck in the office, not objecting to the shared hotel room, referring to herself in such a way as to insinuate that she was a promiscuous person, and wearing "revealing" clothing in the workplace. Mark also claimed that Sheila was not qualified for the job, and had a record of poor job performance. Mark admits that there was some joking around at the office of a sexual nature, but insists that Sheila participated in the joke telling. Discuss
