Furthermore, due to a history of legal labor issues arising between the two-sides, it was necessary for State Labor Laws addressing employee versus employer disputes.

In regards to how a relationship is established, " an agency relationship cannot begin or be ratified unless the two sides mutually agree to begin a contract." Sharp, L. A., Moorman, A. M., & Claussen, C. L. (2014). Each side athlete and agent determine an obligation to agree on what is manifested by the agent's ability to deliver on functions and the athlete's ability to perform at the highest level consistently. In addition, the length of time and scope is established. The agreement can be either written out in detail, meaning expressed authority or some justifiable action by both parties that result in an implied agreement existing.

An agent functions as legal representation. The agent is obligated to operate in a way that implies authority both expressed and implied, on behalf of the athlete's expectations and legal right. The agent performs certain duties for the client by representing the best interest and needs of the client to establish certain expected compensation measures. Furthermore, an agent weighs the options offered to the athlete based on the market rate. Develop standards and expectations in which an offer is measured. Examine risk factors and negotiated compensation. Our text tells us that an agent "informs the athlete of their legal rights" Sharp, L. A., Moorman, A. M., & Claussen, C. L. (2014).

An agent is required to disclose details regarding the terms of the relationship legally, financially, and personally. The agent is obligated to act in the best interest of the athlete on any of the aforementioned matters. The duties are known in the text as "Fiduciary" Sharp, L. A., Moorman, A. M., & Claussen, C. L. (2014). Pg.249.
