(a) Statement of Claim:

Draft a claim on Randal's or Rusty's behalf (NOT BOTH) in the fact scenario below utilizing the concepts that support any substantive claim Randal may have, against any party. (sample statement of claim is posted for your review

Fact Scenario:

Rusty, age 21, worked as a roughneck on the employer's drilling rig. The employer instructed him to remove a build-up of ice using a crowbar and pickaxe. After using these tools unsuccessfully for 30 Minutes, Rusty decided the ice with a front-end loader, although he was not authorized to operate this machinery process, he caused approximately S 750.00, in damages to the loader. He also, damaged the Rotor helicopter belonging to "Rig" transport, which had landed on the rig to drop off supplies and workers. Rusty reported the damage to his supervisor but did not tell his supervisor that he had hit the helicopter with the loader Rusty was aware that the helicopter would be taking some of his co-workers to the City. Rusty offered to pay for the damage to the loader. The employer gave him a written warning but dismissed him the next day follow instructions and damaging equipment.

The Pilot of the helicopter is required to inspect the helicopter for damages before and after every flight. The Pilot failed to check the helicopter, before leaving the Drilling rig. The helicopter crashed in a farmer's field, next to a hive of aggressive bees, enroute to the Airport. Some of the Bees escaped in the direction of the Beer Belly Contest. The Pilot was sending a Text message to his Wife, who wanted him to take photographs of the Contest at the time he lost control of the helicopter and was not authorized to fly over the Beer Belly contest or to change route without permission from the employer. The rules of the contest required contestants to wear a hole cut to the size of their stomach, to allow the judges to see and determine who had the best beer belly. Randal, a contestant, was not wearing a T-shirt when the Bees, descended on the beer belly contestants. He also had shined his Stomach with oil that attracted Bees. Randal, who is allergic to Bee stings, suffered a seizure. The Bottle did not indicate that the scent attracted Bees. The warning on the bottles was as follows: this product is not to be used while camping or in wooded areas known to be inhabited by Bees.
