Scenario: Carol, who is of fairly low intelligence, decides to try out her new high-powered air rifle by shooting at squirrels in the grounds of a hotel, from the top of a hill about 500 metres

away. Her shot breaks a bedroom window.

Consider the liability of Carol for simple criminal damage, in each of the following

permutations:

(a) She hopes to damage something (as well as to kill squirrels).

(b) She hopes not to damage anything (other than the squirrels) but she assesses

her chances of damaging anything else as:

(i) almost definite;

(ii) highly probable;

(iii) more likely than not;

(iv) unlikely; or

(v) nil.

(c) It never occurs to her that she may damage anything except squirrels.

(d) Carol wanted to hit the car of her ex-boyfriend, Paul. She thought she was most

unlikely to succeed.

(e) She wanted to hit Paul, who was walking past the hotel at the time.
