Negotiation Buyer: * *Do not read or share the information listed on this page with the other party!!* * You are trying to buy a leather jacket from a street vendor. You really like one of the jackets they are selling. It is a good fit, well made, nice material and stylish. However, you think the vendor is asking too much. Can you negotiate an acceptable price for both of you? You have a maximum of $80 in cash. You do also have your credit cards but you want to avoid using them at all costs. If you use your credit cards you will have to pay a credit card fee of 50% of the value. Which means you must add that fee into the total cost of the jacket if you decide to use your credit card for the sale. You know that generally it is hard for you to find a jacket that fits you so well. You recently saw a similar jacket in a department store for $300.Negotiation The outcome of our negotiation was a comprise between the two parties. It was clear that our nancial ideas were very far apart and that it would be difcult to nd a compromise with which we were both satised. However, it was especially helpful to recognize and understand the background of both our positions and to look at the problem separately from the people. I tried to explain that I am a student and therefore have little money, but of course could also understand that the seller wants to make a prot with the jacket. We tried to focus on the facts, namely that the jacket has good quality and looked very good and not to get personal in the negotiation. In my eyes, this helped a lot to stay objective and be friendly without getting frustrated. Nevertheless, at the beginning it looked as if we would not nd a compromise. Finally, however, the seller had the creative idea that the buyer could work a few hours for him as a form of payment. In my eyes, it helped a lot to also consider unconventional solutions 50 that both parties leave the negotiation with a good feeling in the end. Because that should be the goal of a negotiation in any case. #. Please use the questions below as some potential topics to discuss. . Would it have been different if it was in person v. virtual? Do you think there is a space in the Law for it? Mediation Case: Rick (Neighbor 1) had lived in a street in Brooklyn for many years. Todd (Neighbor 2) had recently moved in next door, and the neighbors had initially been friendly. Todd extended the dividing fence between their properties and added 60 cm to the height of the fence without consulting Rick. Rick was furious with this addition and said the additional height of the fence blocked light to his garden and hindered his view of the street. Rick tried to talk to his neighbors about the fence but both Todd became hostile and refused to speak to him about it. Todd believe they have done nothing wrong. Feeling that there was no way to directly resolve the dispute with his neighbors, Rick called a mediator to ask for help Todd were reluctant to attend because they believed Rick had been spreading rumors and malicious gossip about them however has finally agreed to speak to the mediator. Please attempt to mediate this issue. For those playing the neighbors feel free to really take on the role and elaborate as you see fit. For the mediator attempt to find a solution or resolution for the neighbors
