After a rough day at work, Michelle decides to smoke a cigar on a couch in her living room while she plays the latest version of Call of Duty on her new XBOX ONE gaming machine. During a vicious battle with the enemy, Michelle carelessly places her lit cigar on the carpet near her feet so she can focus on her game. Before she can react, Michelle's carpet, couch, library books and house catch on fire. Although Michelle escapes from her house without injury, her next-door neighbor's house catches fire and burns to the ground. Luckily, her neighbor, Hillary, was not home, but Hillary's dog named "Bieber" catches fire. The blazing Bieber heroically runs 20 blocks down the street before dying underneath a car at a gas station. Bieber's smoldering collar then sparks an explosion of the car at the gas station. The explosion causes the glass windows at the Starbucks across the street to break, and a large piece of glass falls onto a Starbuck's customer named Selena, slicing off her left pinky. Assume that Hillary and Selena separately file lawsuits against Michelle only for ordinary negligence. 1. Will Hillary win her case against Michelle? Discuss completely. 2.
