Holland Spots you and a group of your associates coming back from lunch and motions you all into the conference for an impromptu lesson. He poses the following hypothetical.

Dr. Millard Chase, the current Chair of the BORS, wants to develop a penalty schedule that would be used whenever an adjudication hearing is required. The schedule would top out at the $100,000 fine ceiling set out in the Human Cloning Act. It would also designate, however, the redistribution of any instruments or equipment used in an illicit cloning process to the next closest public institution approved by a BORS' sub-committee. The purpose of the guide is to ensure fair and consistent penalties and to surreptitiously benefit public institutions. Chase does not intend to amend the BORS regulations or the enabling statute, but he does want to approval of a majority of the BORS members on this document. He intends to propose this strategy:

1. Before the full Board at its next public meeting as an agenda item,
2. In a conference room meeting of the full board, no guests permitted.
3. At a private meeting in his office with only those members of the Board present who Chase feels will support this strategy.

NOTE: In addition to the FOIA and the Privacy Act, the BORS must adhere to the Government-In-The-Sunshine Act ("Sunshine Act") in all its operations and procedures.
